The penalty notice of the StA Braunschweig allows suspicion of fraud

The German magazine FOCUS has just reported that there are increasing indications of fraud in newer diesel cars with the EA 288 engine compared to VW. The magazine relies on the administrative fine from the Braunschweig public prosecutor from 2018, with which VW was sentenced to pay a € 1 billion fine and profit skimming.

The notification would show that type approvals for the EA 189 and EA 288 diesel engines were applied for and obtained from the relevant authorities in various European countries without referring to a built-in switchover logic for exhaust gas cleaning. In Germany alone, 2.8 million vehicles are affected by the fraudulent software. A list of the vehicles is attached to the notification, but the StA Braunschweig does not publish this list.

“What we have always suspected should now come to light with certainty: VW has evidently also fraudulently deceived authorities and customers with the EA 288 engine and therefore – according to the line of the Federal Court of Justice (BGH) – has to pay damages for these vehicles as well,” says Peter Kolba, chairman of the consumer protection association (VSV). “We collect vehicle owners who have already been affected in order to mediate these cost-free and risk-free lawsuits.”
