The state government of North Rhine-Westphalia apparently wants to force the city of Kerpen to uphold the appeal against a judgment of the Cologne administrative court. As “Kölner Stadt-Anzeiger” and “Kölnische Rundschau” (Thursday edition) learned from administrative circles, the state signaled that it would not accept a decision made by the Kerpen city council on Tuesday evening. A narrow majority from the SPD, the Greens, the Left and the UWG prevailed against the will of Mayor Dieter Spürck as well as the CDU and BBK and decided to withdraw the appeal.

The Cologne court had called the evacuation of the occupied Hambach Forest in 2018 unlawful because it was justified by the fact that the tree houses of the forest occupiers in the forest were not fireproof. This reason, according to the court ruling, was only a pretext. Immediately after the Cologne ruling at the beginning of September, representatives of the state expressed the wish that the city of Kerpen should appeal the ruling. The city, on the other hand, emphasized that it was free in its decision-making.
