Oldenburg Higher Regional Court strengthens the economy against the warning industry

Law firms have to disclose mass warnings – Osnabrück entrepreneurs are also successful in the second instance

Osnabrück. The Higher Regional Court (OLG) Oldenburg has backed companies against warning associations and law firms. In the second instance, the OLG confirmed a ruling by the Osnabrück Regional Court: Anyone who warns a company must disclose to the court at the latest with the application for an interim injunction whether a large number of similar warnings were sent out at the same time. That reported the “Neue Osnabrücker Zeitung”. In particular, the General Data Protection Regulation (GDPR) or the lack of certificates on websites have repeatedly used warning associations and law firms as an opportunity to warn many companies at the same time about violations.

For the lawyer Marcus von Welser, who represents the Osnabrück entrepreneur, the decision is “trend-setting for the economy and a big step in the right direction”, he told the “NOZ”. The reason: Although the Bundestag introduced the “Law to Strengthen Fair Competition” (UWG) last year to put a stop to the warning industry, other courts were previously more reluctant to implement the UWG reform. This is the main reason why the decisions from Osnabrück and Oldenburg are remarkable, said von Welser.

He criticized the previous warning practice: “In many cases, the person warned does not even know that the warning he has received is part of a large wave of warnings.” The decisions of the Oldenburg Higher Regional Court and previously the Osnabrück Regional Court would now consistently implement the will of the legislature to prevent the abuse of warnings in judicial practice, von Welser continued.
